1. Payment Terms

Important: Failure to make timely payment may result in automatic cancellation of your booking without refund of the advance amount. Payments are considered received only upon clearance of funds in Indo Heights Travel & Tours’ bank account.

  • All payments must be made in Indian Rupees (INR) unless specified otherwise.
  • Travelers are responsible for ensuring compliance with RBI / FEMA guidelines regarding foreign remittances; Indo Heights Travel & Tours shall not be liable for penalties arising from non-compliance.”

2. Cancellation Period (from travel date) Cancellation Charges:

Cancellation Terms

  • All cancellations or amendments must be communicated in writing via official channels, including email, WhatsApp, SMS, or letters sent to the registered office. Requests received through other channels (personal email, social media, or informal messages) will not be considered valid.
  • Indo Heights Travel & Tours reserves the right to amend cancellation charges in accordance with third-party provider policies.
  • Cancellation charges are non-refundable and include all taxes, service charges, and third-party fees.
  • No refund, full or partial, will be provided for unused services once the tour commences.
  • Cancellation periods are calculated in calendar days (IST), including public holidays, and apply to all bookings and third-party service providers.
  • Office Hours & Request Submission: Our office working hours are 10:00 AM to 6:00 PM (IST), Monday to Saturday. All cancellation or amendment requests must be submitted during office working hours. Requests made outside these hours, on non-working days, or public holidays will be processed on the next working day. A cancellation request shall be deemed received only when received via official channels during office hours.”

3. Refund Policy:

  • Refunds, if applicable, will be processed within 15-30 working days from written cancellation confirmation, excluding non-working days and public holidays for processing purposes.
  • Refunds are made only via bank transfer after deducting applicable cancellation and service charges.
  • Services booked under non-refundable or promotional rates are strictly non-refundable.
  • Refunds depend on receipt from respective service providers (hotels, airlines, cruises, etc.).
  • Indo Heights Travel & Tours is not liable for delays in refund caused by third-party providers.

4. Visa & Documentation:

  • Visa issuance is at the sole discretion of the respective embassy or consulate.
  • Indo Heights Travel & Tours cannot guarantee visa approval, even with assistance.
  • In case of visa rejection, visa fees and processing charges are non-refundable.
  • Standard cancellation charges for the remaining package cost will still apply.
  • Travelers must provide accurate and complete documentation; any delay or denial due to incomplete information is the responsibility of the traveler.
  • Indo Heights Travel & Tours will not be responsible for any penalties, fines, or legal implications arising from incorrect, incomplete, or falsified documentation

5. Peak Season / Holiday Periods:

  • During Christmas, New Year, Diwali, school holidays, or long weekends, higher cancellation charges may apply per hotel, airline, or cruise policies.
  • These additional charges will be communicated at the time of booking in writing and are non-negotiable.

6. Booking Conditions:

  • 50% of the land package cost is required to initiate the booking; the remaining 50% is due 30 days before departure.
  • 100% payment is required for bookings made within 30 days of travel.
  • All bookings are subject to availability at the time of confirmation.
  • No refund will be provided for unused services or no-shows.
  • Full payment must be received prior to commencement of travel.
  • Travelers acknowledge that itineraries may be modified due to circumstances beyond the control of Indo Heights Travel & Tours, including weather, transportation delays, or local regulations

7. Green Initiative - Digital Documentation:

  • All travel-related documents (e-vouchers, e-itineraries, and e-tickets) will be delivered electronically via email and WhatsApp.
  • Physical copies will only be provided upon request, with additional charges communicated in advance.
  • This supports environmental sustainability and ensures secure and prompt delivery.
  • Delivery of documents via digital channels shall be deemed valid and legally binding

8. DGCA Compliance – 24-Hour “Look-In Option” for Air Tickets:

  • Passengers may cancel or modify air ticket bookings within 24 hours of ticket issuance without additional charges, except for applicable fare differences.
  • Service Charge: Rs. 500 per passenger for cancellations or amendments under the “Look-In Option.”
  • The Look-In Option applies only to tickets issued through Indo Heights Travel & Tours and is subject to the rules of the issuing airline.
Exclusions:
  • Flights scheduled to depart within 7 days from the date of booking.
  • Non-refundable tickets.

9. Legal Disclaimer:

Role of Indo Heights Travel & Tours

  • Acts solely as a facilitator between travelers and independent service providers (airlines, hotels, transport, cruise operators, and other partners).
No Direct Control
  • Indo Heights Travel & Tours does not control operations, safety standards, or services of third-party providers.
  • Any deficiency, delay, or mishap arising from these providers is not attributable to Indo Heights Travel & Tours.
Limitation of Liability
  • Indo Heights Travel & Tours shall not be liable for any loss, injury, accident, delay, cancellation, theft, or damage caused by third-party providers.
  • Claims must be addressed directly with the service provider; Indo Heights may assist in communication but assumes no liability.
Indemnity
  • Travelers agree to indemnify and hold harmless Indo Heights Travel & Tours from claims, liabilities, losses, or damages arising from participation in third-party services.
Travel Insurance
  • Comprehensive travel insurance covering accidents, medical emergencies, luggage loss, trip cancellations, or other unforeseen events is strongly recommended. Indo Heights Travel & Tours shall not be liable for any claims arising from lack of coverage.
Force Majeure
  • Indo Heights Travel & Tours shall not be liable for delays, cancellations, or other disruptions due to natural calamities, political unrest, acts of God, or other circumstances beyond its control.
  • Indo Heights Travel & Tours shall notify travellers of force majeure events as soon as reasonably possible; however, no refunds or compensation are guaranteed.

10. Complaints & Escalation Policy:

Submission of Complaints
All complaints or service-related issues must be submitted in writing via official channels:
  • Complaints: complaints@indoheightstravel.com
  • Escalations: escalation@indoheightstravel.com
  • Other channels: WhatsApp or SMS to the registered official numbers.
Submission via unofficial channels (personal emails, social media, WhatsApp messages not registered) shall not be considered valid for legal or official purposes.
Office Hours & Acknowledgment:
  • Complaints received during office hours (10:00 AM – 6:00 PM IST, Monday to Saturday) will be acknowledged within 24 working hours.
  • Complaints received outside office hours, on non-working days, or public holidays will be acknowledged on the next working day.
  • A complaint is deemed officially received only when submitted via the above official channels during office hours.
Resolution Process:
Indo Heights Travel & Tours shall make all reasonable efforts to resolve complaints promptly.
  • Standard resolution timeframe is within 7–15 working days from the date of acknowledgment, depending on the complexity of the issue and the cooperation required from third-party service providers.
  • Complex issues requiring coordination with airlines, hotels, or other service providers may take longer; in such cases, travellers will be kept informed of progress.
Escalation:
  • If a complaint is not resolved satisfactorily within 7 working days, it may be escalated to the Director / Head of Operations for review.
  • Escalations must be submitted via escalation@indoheightstravel.com.
Final Authority:
  • The decision of Indo Heights Travel & Tours following escalation shall be final and binding, subject to applicable laws of India.
Jurisdiction:
  • All disputes arising from complaints or escalations will be under the exclusive jurisdiction of the Courts of Delhi, India.

11. Airline, Hotel and Ground transportation Terms and Conditions:

Airline Terms:
  • Passengers must arrive at the airport at least 3 hours before international flights and 2 hours before domestic flights.
  • Airlines may have specific baggage, check-in, and boarding policies; travellers must comply with these.
  • Web check-in is mandatory. If the traveller requests Indo Heights Travel & Tours to perform web check-in, a service charge of Rs. 500 per passenger will apply.
  • Travelers are responsible for checking prohibited items on the flight as per airline regulations.
  • Please verify baggage allowance at the time of ticket issuance. Any excess baggage will incur additional charges payable directly at the airline counter.
  • Seat selection is chargeable. If the traveller opts for auto seat allocation, adjacent seats cannot be guaranteed.
  • Please check with the airline regarding food service. Many airlines charge for food; if meals are included, travellers must specify food preferences at the time of ticket issuance.
  • Indo Heights Travel & Tours is not responsible for delays, missed flights, or denied boarding due to late arrival or non-compliance with airline rules.
  • Flight schedules are subject to change by the airline; Indo Heights Travel & Tours will inform travellers of changes but shall not be liable for any consequential losses.
Hotel Terms:
  • Standard check-in time is 1400 hrs, and check-out time is 1200 hrs.
  • Early check-in or late check-out may incur additional charges, payable directly by the traveler at the hotel.
  • Travelers are advised to check the official website and online reviews of the selected hotels before confirming the booking. Indo Heights Travel & Tours shall not be liable for differences in facilities or services as compared to online descriptions or reviews.
  • Once the booking is confirmed, amendments or changes to the selected hotels, either before or during the tour, are not permitted.
  • Please verify hotel policies regarding usage of the mini-bar, as these charges are often applicable.
  • Travelers must follow hotel rules. Any damage to hotel property will be charged directly by the hotel and is the responsibility of the traveller.
  • Any extra service charges, such as room service or additional amenities, must be settled directly at the hotel at the time of check-out.
  • Indo Heights Travel & Tours is not responsible for hotel service deficiencies, including room allocation, amenities, or operational issues.
  • Special requests (room type, bedding preference, smoking/non-smoking rooms) are subject to hotel availability.
Transportation / Transfers Terms:
  • Transfers & Sightseeing: All transfers, sightseeing tours, and related transportation will be provided as per the confirmed itinerary. Any changes or additions to the itinerary may result in additional charges, payable directly to the transportation provider.
  • Inclusions: Standard parking charges, tolls, fuel, and driver allowance are included in the package cost, unless otherwise specified.
  • Additional Stops / Extra Distance: If travellers request stops at additional locations, extended routes, or additional sightseeing beyond the confirmed itinerary, extra charges will apply and must be paid directly to the transportation provider or cab agency.
  • Vehicle Type & Comfort: The vehicle type (sedan, SUV, coach, or van) is confirmed at the time of booking. Any upgrade or change in vehicle type requested later may incur additional charges.
  • Timings & Punctuality: Travelers are responsible for being present at the designated pick-up points on time. Indo Heights Travel & Tours is not liable for delays caused by travellers missing scheduled pick-ups.
  • Driver Conduct & Responsibility: Drivers are provided by third-party transportation vendors. Indo Heights Travel & Tours shall not be liable for any behaviour, personal injury, or loss caused by drivers. Travelers must follow safety instructions and local traffic regulations.
  • Unforeseen Circumstances: Delays, rerouting, or cancellations due to traffic, weather, roadblocks, or government regulations are beyond the control of Indo Heights Travel & Tours and do not entitle travellers to refunds or compensation.
  • Liability: Indo Heights Travel & Tours acts solely as a facilitator for transportation services. Any disputes, damages, or claims arising from transportation services must be addressed directly with the service provider; Indo Heights may assist in communication but assumes no liability.
  • Special Requests: Any requests for extra luggage handling, specific stops, or additional services must be communicated in writing before the travel date. Charges for such requests are payable directly to the service provider.

12. Tax Deduction and Collection Policy (TDS / TCS)

1. Applicability of TDS:
  • 1.1. As per the provisions of the Income Tax Act, 1961, Indo Heights Travel & Tours may be required to deduct Tax Deducted at Source (TDS) on payments received from clients for travel services.
  • 1.2. Domestic Travel (within India):
    • TDS shall apply on payments made by corporate entities or HUFs where the total payment exceeds the threshold limit prescribed under the Income Tax Act.
    • Payments made by individual clients for domestic travel shall generally not attract TDS; however, provision of PAN is mandatory for record-keeping and compliance purposes.
  • 1.3. Foreign Travel (International Packages):
    • TDS may be applicable on payments made by corporate clients exceeding the prescribed threshold limits.
    • For individual clients, TDS is generally not applicable; however, clients must provide accurate PAN and other KYC documentation as required.
    • Indo Heights Travel & Tours shall deduct TDS/TCS at the rates prescribed under applicable law. Clients remain responsible for any discrepancy or additional tax liability as per Income Tax provisions.

2. Applicability of TCS:

  • 2.1. Pursuant to Section 206C(1G) of the Income Tax Act, 1961, Tax Collected at Source (TCS) may be applicable on payments for foreign travel packages where the total payment in a financial year exceeds INR 7,00,000.
  • 2.2. TCS shall be collected by Indo Heights Travel & Tours at the rate prescribed under the Income Tax Act and shall be remitted to the Government of India.
  • 2.3. Clients shall be issued a TCS certificate which may be used for claiming credit while filing their income tax returns.

3. Client Obligations:

  • 3.1. Clients shall furnish accurate PAN and other KYC details as may be required to ensure proper TDS/TCS computation and compliance.
  • 3.2. Indo Heights Travel & Tours shall not be liable for any penalties, interest, or disputes arising from incorrect, incomplete, or delayed submission of PAN/KYC information.

4. Refund of TDS/TCS:

  • 4.1. Clients may claim refund of TDS or TCS directly from the Income Tax Department, in accordance with applicable laws.
  • 4.2. Indo Heights Travel & Tours shall provide all necessary documentation, including TDS/TCS certificates, to facilitate such claims.

5. Disclaimer:

  • 5.1. The provisions of this clause are without prejudice to the agency’s other rights and obligations under these Terms & Conditions or applicable law.
General Disclaimer
  • Any disputes or claims arising from bookings with Indo Heights Travel & Tours shall first be attempted to resolve through mutual discussion or mediation between the parties prior to approaching any court of law.
  • All disputes or claims shall be subject to the exclusive jurisdiction of the Courts of Delhi, India.
  • By confirming a booking with Indo Heights Travel & Tours, the traveler expressly acknowledges and accepts all terms and conditions set forth herein, including, without limitation, the provisions relating to payment, cancellation, refund, escalation, airline and hotel policies, TDS/TCS, limitations of liability, indemnity, and force majeure.
